Official Rules

NO PURCHASE, PAYMENT, DONATION, OR OTHER CONSIDERATION IS NECESSARY TO VOTE. A PURCHASE, PAYMENT, DONATION, OR OTHER CONSIDERATION WILL NOT INCREASE NUMBER OF VOTES. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

OFFICIAL RULES

These Official Rules govern the Peaks Elite Online Fan Voting (“Online Voting”). By submitting a vote, each voter agrees to comply with these Official Rules and Sponsor’s decisions regarding the administration and validation of the Online Voting, subject to applicable law.

1. Sponsor

The Online Voting is not sponsored, endorsed, administered by, or associated with any social media platform, voting platform or other third party unless expressly stated by Sponsor in writing.

2. Online Voting Overview

Online Voting is one component of the Peaks Elite Brand Ambassador selection process. Valid vote totals will be considered alongside Sponsor’s established program criteria, eligibility requirements and final review. Receiving the highest number of votes does not guarantee selection as a Peaks Elite Brand Ambassador. Sponsor retains final authority over all Peaks Elite selection decisions.

Winners are determined by adherence to corporate guidelines and the number of valid votes received, subject to eligibility verification, fraud review, compliance with these Official Rules, and Sponsor’s right to disqualify invalid votes, fraudulent activity, or other noncompliance.

This Online Voting determines only Peaks Elite winners and does not confer employment, agency, franchise, modeling representation, or guaranteed commercial opportunities.

Sponsor may invalidate votes submitted through fraud, cheating, tampering, bots, scripts, artificial intelligence, automated systems or other unauthorized methods. Sponsor may take additional action regarding a candidate only if Sponsor reasonably determines that the candidate authorized, directed, knowingly participated in or encouraged the prohibited conduct. Any suspected or actual fraud, cheating, or tampering associated with an entrant or voter, including but not limited to use of artificial intelligence and/or, any other unauthorized AI, robotics, bots, malware, or other unauthorized participation methods, as solely determined by Sponsor, will result in disqualification of the entrant.

3. Voting Period

The Online Voting begins at 10:00am Central Time on Friday, August 21, 2026, and ends at 11:59pm Central Time on Sunday, September 13, 2026 (“Online Voting Period”).

The Online Voting Period includes the following phase:

  1. Voting Period: 10:00am Central Time on Friday, August 21, 2026, through 11:59pm Central Time on Sunday, September 13, 2026

Sponsor’s computer, server, platform logs, or designated official timekeeping system will be the official timekeeping device for the Online Voting Period.

4. How to Vote

Voting is open to legal residents of the 50 United States, the District of Columbia and Mexico who are at least 18 years old at the time of voting and have a valid email address. Twin Peaks employees may vote, subject to the same requirements and voting limits as all other voters. Void where prohibited by law.

During the Voting Period, eligible voters may vote by visiting www.twinpeaksrestaurant.com/peakselite or www.peakselite.com and following the instructions. Voters must successfully complete the required email authentication process before their votes will be accepted.

Voting Limit: Each eligible voter may cast up to three (3) votes per day during the Voting Period. Voters may cast all three votes for one candidate or distribute their votes among up to three different candidates. A “day” begins at 12:00 a.m. Central Time and ends at 11:59 p.m. Central Time. Unused votes do not carry over to another day.

Email Authentication: A valid email address is required to vote. Voters must complete the email authentication process before their votes will be accepted. Each voter may use only one authenticated email address and may not use multiple, temporary, disposable, fictitious or shared email addresses to exceed the daily voting limit. All votes are final once submitted and may not be changed, withdrawn, transferred or carried over. Sponsor’s official voting-platform records will determine when a vote was received and the number of valid votes submitted by each voter.

Voting is free. No purchase, payment, donation, subscription, paid membership, or other consideration is required to vote. Sponsor and its voting-platform provider may use email authentication, IP address, device information and other reasonable fraud-prevention measures to enforce voting limits and validate votes. Sponsor may disqualify a voter and invalidate any vote associated with prohibited conduct. Votes must be submitted through the official voting platform. Votes submitted by any other method will not count. Fan voting is intended to inform the selection process but is not the sole determining factor. Vote totals do not create any entitlement to finalist or winner status, and all selections remain subject to Sponsor’s evaluation, verification, and final approval.

5. Prohibited Voting Conduct

  1. Use of bots, scripts, macros, automated voting systems, vote farms, click farms, or other automated or artificial means;

  2. Use of multiple email addresses, fake accounts, disposable accounts, false identities, or proxy identities to exceed voting limits;

  3. Buying, selling, trading, or offering compensation for votes;

  4. Offering prizes, incentives, sweepstakes entries, gifts, discounts, payments, or other consideration in exchange for votes;

  5. Tampering with the voting platform or Online Voting website;

  6. Coordinated activity intended to circumvent voting limits or artificially manipulate vote totals.

  7. Use of VPNs, proxies, device spoofing, or location spoofing to evade voting restrictions;

  8. Harassment, intimidation, bullying, or deceptive solicitations to obtain votes;

  9. Any conduct that violates applicable law, platform rules, or these Official Rules.

Sponsor may disqualify a voter and invalidate any vote associated with prohibited conduct. Sponsor may take action regarding a candidate only if Sponsor reasonably determines that the candidate authorized, directed, knowingly participated in or encouraged the prohibited conduct.

After the Voting Period closes, Sponsor may review voting data and invalidate fraudulent, suspicious, duplicate, automated, ineligible or otherwise noncompliant votes. Valid vote totals will be considered as one component of Sponsor’s Peaks Elite selection process. Vote totals do not independently determine or guarantee selection.

6. FTC Endorsement and Social Media Disclosure

Voters who post about the Online Voting must make truthful statements and may not misrepresent their relationship with Sponsor, the validity of any vote totals or the status of any candidate. Any person who has a material connection with Sponsor must disclose that connection as required by applicable law.

Information collected from voters will be used to administer the Online Voting, verify eligibility, prevent fraud, comply with legal obligations, and for other purposes described in Sponsor’s privacy policy.

By participating, voters acknowledge that their information may be processed in the United States and may be shared with service providers, legal advisors, and other parties necessary to administer the Online Voting.

Sponsor will not require sensitive personal information except as reasonably necessary for eligibility verification, fraud prevention, or legal compliance.

Online Voting Administration. By registering and submitting a vote, Voters consent to Sponsor’s collection and use of their registration and vote-submission information, including name, and related details (“Voter Data”), for purposes of administering the Online Voting, in accordance with these Official Rules and Sponsor’s Online Privacy Policy, available at www.twinpeaksrestaurant.com/legal.

Promotional Communications. As a condition of voting in the Online Voting, Voters will be registered to receive emails and additional communications from Sponsor and its designees by email or other media regarding the Online Voting and Sponsor’s featured products, discounts, special events, and/or promotional offers (“Promotional Communications”). Voters may opt out at any time using the Unsubscribe link in any promotional email.

By registering and submitting a vote, voters acknowledge Sponsor’s collection and use of their email address, email-authentication status, voting activity, IP address, device information and related fraud-prevention data for purposes of administering and protecting the integrity of the Online Voting, in accordance with Sponsor’s Online Privacy Policy.

Opt-Out: Voters may opt out at any time using the “Unsubscribe” link in any marketing email. To the extent Sponsor discloses or transfers Voter Data to a third party in a manner that constitutes a “sale” or “sharing” of personal information under applicable state privacy law, Sponsor will provide Voters a clear and conspicuous mechanism to opt out of that sale or sharing, as further described in Sponsor’s Online Privacy Policy.

7. General Conditions

Sponsor reserves the right to cancel, suspend, modify, or terminate the Online Voting if fraud, technical failures, platform failures, viruses, bugs, unauthorized intervention, legal restrictions, force majeure events, or any other factor impairs the integrity, security, fairness, or proper administration of the Online Voting.

If the Online Voting is canceled or terminated, Sponsor may determine how, if at all, valid votes received before the cancellation or termination will be considered in the Peaks Elite selection process. Sponsor reserves the right to disqualify any person who tampers with the entry process, voting process, website, platform, or Online Voting administration, or who acts in an unsportsmanlike, disruptive, abusive, deceptive, or unlawful manner.

8. Release

To the fullest extent permitted by applicable law, by participating in the Online Voting, each voter agrees to release and hold harmless Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotion agencies, voting-platform providers, and each of their respective officers, directors, employees, agents, representatives, successors and assigns from claims, damages, losses, liabilities, costs or expenses arising out of or relating to:

  1. The voter’s submission or attempted submission of a vote;

  2. Technical, network, platform, email-authentication, device or human errors;

  3. Delayed, lost, incomplete, inaccurate or improperly processed voting submissions;

  4. Unauthorized access to or alteration of voting data;

  5. Vote manipulation or attempted vote manipulation;

  6. The rejection, removal or invalidation of votes under these Official Rules; or

  7. The voter’s violation of these Official Rules.

Sponsor is not responsible for votes that are lost, late, incomplete, inaccurate, delayed, misdirected, corrupted or not received because of technical, platform, network, email, browser, device or internet failures; unauthorized intervention; voting-platform errors; or inaccurate information provided by a voter.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPONSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, DATA, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATED TO THE ONLINE VOTING, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SPONSOR’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE ONLINE VOTING SHALL NOT EXCEED US$100.

Nothing in these Official Rules limits liability where prohibited by law.

10. Indemnification:

To the fullest extent permitted by applicable law, each voter agrees to indemnify and hold harmless Sponsor, its parent companies, subsidiaries, affiliates, voting-platform providers, and each of their respective officers, directors, employees, agents, representatives, successors and assigns from third-party claims, liabilities, damages, losses, costs and reasonable attorneys’ fees arising directly from the voter’s:

  1. Fraudulent or unlawful conduct in connection with the Online Voting;

  2. Intentional manipulation or attempted manipulation of the voting process;

  3. Knowing use of bots, scripts, multiple email addresses, false identities or other prohibited voting methods; or

  4. Material breach of these Official Rules.

This indemnification obligation does not apply to claims arising from Sponsor’s own negligence, willful misconduct, privacy practices, candidate-selection decisions or administration of matters within Sponsor’s exclusive control. Nothing in this section requires a voter to indemnify any party where prohibited by applicable law.

11. Disclaimer of Warranties:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ONLINE VOTING AND ALL RELATED SERVICES, CONTENT, TECHNOLOGY, FEATURES, COMMUNICATIONS, DECISIONS, RESULTS, RANKINGS, SCORING, JUDGING, VOTING, PRIZES, AND ACTIVITIES ARE PROVIDED WITHOUT WARRANTY OF ANY KIND.

THE SPONSOR EXPRESSLY DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, PERFORMANCE, SECURITY, ACCURACY, AUTHENTICITY OF VOTES, FREEDOM FROM MANIPULATION, OR THAT ANY PARTICIPANT WILL RECEIVE ANY PARTICULAR BENEFIT, EXPOSURE, RECOGNITION, RANKING, SCORE, OR RESULT.

12. Sponsor’s Administrative Discretion:

To the fullest extent permitted by applicable law, the Sponsor reserves the right, in its sole and reasonable discretion, to interpret and administer these Official Rules and to resolve any question, dispute, ambiguity, error, omission, or circumstance not expressly addressed herein. Sponsor may modify, suspend, extend, shorten, cancel, or terminate the Online Voting, in whole or in part, or modify any selection procedure, judging criterion, voting process, prize, benefit, experience, finalist designation, or winner designation if Sponsor determines that fraud, misconduct, technical failure, human error, unauthorized interference, legal or regulatory requirements, safety concerns, reputational risk, circumstances beyond Sponsor’s reasonable control, or any other condition has impaired or may impair—the integrity, fairness, security, administration, or intended purpose of the Online Voting.

Online Voting, if any, is only one component of the selection process and does not independently determine any finalist or winner. Sponsor retains final authority to select, verify, disqualify, replace, or rescind the designation of any finalist or winner based on the criteria stated in these Official Rules, eligibility requirements, compliance with Sponsor policies, conduct inconsistent with the values or reputation of Sponsor or the Peaks Elite program, or information discovered before or after an announcement. No entrant, finalist, or potential winner will be deemed an official winner unless and until Sponsor has completed all required verification and provided written confirmation of that designation.

If a finalist or winner is disqualified, becomes ineligible, declines or is unable to participate, violates these Official Rules or any applicable agreement or policy, or if Sponsor determines that the individual’s continued participation could subject Sponsor or its affiliates to legal, operational, safety, or reputational risk, Sponsor may revoke that individual’s status and select an alternate using the original criteria, an adjusted selection process reasonably suited to the circumstances, or no alternate at all, to the extent permitted by law. Sponsor may substitute any prize, benefit, appearance, or experience with one of equal or greater approximate value when reasonably necessary. Any material modification will be communicated through the same channel in which these Official Rules were made available or through another method reasonably calculated to notify affected participants. Sponsor’s decisions are final and binding, subject to applicable law.

13. Disputes; Governing Law

Except where prohibited by law, all disputes arising out of or relating to the Online Voting or these Official Rules will be governed by the laws of the State of Texas, without regard to conflict-of-law rules.

Except where prohibited by law, each participant agrees that:

  1. Any and all disputes, claims, and causes of action arising in connection with this Contest shall be resolved individually, and not as part of a class, consolidated or representative action;

  2. The exclusive venue for any dispute will be the state or federal courts located in Dallas, Texas;

  3. Voter waives any right to a jury trial, to the extent permitted by law; and

  4. Voter may not recover punitive, incidental, consequential, or special damages, attorneys’ fees, or costs including but limited to legal costs, unless required by law. Under no circumstances will voter be permitted to obtain awards for, and voter hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of voter and Sponsor in connection with this Online Voting, shall be governed by, and construed in accordance with the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules or provisions.
